Our Florida Debt Recovery Process

This is a generalized list of the debt recovery process. All debt recovery claims are somewhat unique and may not necessarily follow this pattern.

  • Time frames are purposefully omitted because of the uniqueness and handling of each Florida debt recovery claim

  • Not included in this list is the fact that at any point in the debt recovery process the debtor may pay or otherwise satisfy the debt.

  • Our debt recovery firm can accommodate special Florida debt recovery requests.

  • We provide timely updates on Florida debt recovery claims as they develop.

  • With regard to payment, when the payment is received by the client directly, the client notifies us immediately and we send them an invoice for our Florida  debt recovery commission. When we receive a Florida debt recovery payment, we remit to the Client after the funds clear our attorney trust account.

  • All  Florida debt recovery claims are handled in accordance with the Fair Debt Collection Practices Act.

The Florida Debt Recovery Process:

  •  A Florida debt recovery  collection account is placed for debt recovery with our law firm.

  • Client sends information on the Florida  debt recovery including supporting documentation.

  • The Florida debt recovery claim  is reviewed by a collection lawyer and the data is entered into our debt recovery system

  • Demand letter is sent to debtor via fax, mail and or email and an acknowledgment letter is sent to the Client of their Florida debt recovery collection claim.

  • Phone contacts begin to attempt Florida  debt recovery . We attempt to arrange payment, resolve any disputes and obtain clear commitments on Florida  debt recovery resolution.

  • If we obtain payment commitment from the debtor we work to ensure the payment(s) materialize.

  • If debtor fails to cooperate in resolving the debt we make final pre-legal Florida  debt recovery attempts.

  • We send our update and recommendations to the Client, including details on forwarding claim to affiliated attorneys if the debt recovery is outside of Florida

  • When we receive suit requirements  for collection from the Client, the lawsuit is prepared and filed. When we do not received suit requirements or when the client is unwilling to litigate the Florida debt recovery  collection claim the attorneys will work on the claim for another 60 days then close it.

  • The complaint is served on the debtor for the Florida  debt recovery collection balance  due.

  • Our  collection attorney will file for default judgment if no answer is filed by  debtor. If an answer is filed the discovery process begins and a trial date is later set on the Florida  debt collection account

  • If a judgment is awarded in our favor, collection attorneys may file for a Writ of Attachment.

  • Attorneys attempt to locate and verify  and recover debtor assets.

  • Attorneys initiate bank levies/ garnishment orders/ liens/ etc. to satisfy the judgment.
  •   Our Florida debt recovery collection client is notified of all relevant events on their attorney collection matters
